Terms of Service: Estate Clearing Toronto

1. Agreement to Terms

By using this website or engaging Estate Clearing Toronto for services, you agree to these Terms of Service. The specific scope, schedule and price of any project are set out in your written itemized quote, which forms part of our agreement with you. If the quote and these terms differ, the quote applies.

2. Services

Estate Clearing Toronto provides estate clearing and estate cleanout services in Toronto and the GTA, including:

We do not provide legal, tax or financial advice, and our sorters do not issue certified appraisals. We coordinate with your professionals when you authorize us to.

3. Authority to Instruct

By signing a quote, you confirm that you are the owner of the property or are legally authorized to act for the owner or the estate, for example as executor, estate trustee or attorney for property, and that you have authority to direct how its contents are handled. Where authority is shared, we may require instructions from all authorized parties.

4. Quotes, Pricing and Payment

  • Quotes are written, itemized and provided after an in-home consultation, normally within 48 hours.
  • All prices are in Canadian dollars. Published tiers range from $2,500 to $25,000; hourly senior sort and pack is $85 per sorter per hour with a 3-hour minimum.
  • Auction coordination is 15% of hammer price, with no upfront cost, deducted from auction proceeds.
  • No rush fees are added after the quote is accepted. Changes to scope requested by you are confirmed in writing before work proceeds.
  • Payment terms are confirmed in the quote. We accept cash, credit card, e-transfer and cheque.

5. Scheduling and Cancellation

Schedules are set around the executor, beneficiaries and any deadlines you provide. Please give at least 48 hours' notice to reschedule a booked day. Late cancellations may incur a charge for crew time already reserved, as set out in your quote.

6. Sentimental Items, Valuables and Papers

Sentimental items, papers and identified valuables are set aside and held for review, and nothing sentimental is discarded without family review. You are responsible for telling us about items the family wishes to keep and for giving clear instructions on disposition. Items are routed to beneficiaries, auction, donation or disposal only on your instruction.

7. Donations and Auctions

Donation partners decide what they accept and whether they issue receipts. Auction results depend on market demand, and we do not guarantee any sale price. Unsold items are handled according to your instructions.

8. Workmanship Warranty

Every scope includes a written workmanship warranty describing what is covered. If something is not right, please contact us promptly and we will work with you to resolve it.

9. Insurance and Liability

We are fully WSIB covered and carry $2M liability insurance, and all crew members are background-checked and bonded. To the extent permitted by law, Estate Clearing Toronto is not liable for indirect, incidental or consequential losses, or for pre-existing conditions of the property or its contents.
