## The Most Common Timing Question

"Can we start clearing the house now, or do we have to wait for probate?" It is one of the first questions executors ask us, usually because a vacant home is costing money or a family wants to begin while relatives are still in town.

The honest answer has two parts. Securing and documenting the contents can usually begin early. Dispersing them, meaning selling, giving away or donating, is a decision to make with your estate lawyer. This guide explains the difference and how

is scheduled around it. It is general information, not legal advice.

## Securing vs Dispersing

| | Securing | Dispersing |
| --- | --- | --- |
| What it means | Protecting and recording the contents | Contents leaving the estate's control |
| Examples | Locking up jewelry, finding papers, building an inventory, photographing keepsakes | Selling at auction, giving items to beneficiaries, donating, disposing |
| Typical timing | Early, often in the first weeks | When your lawyer confirms it is appropriate |
| Risk if done early | Low | Can create questions about authority and fairness |

## What Executors Commonly Do Before the Certificate

While an application for a Certificate of Appointment of Estate Trustee is being prepared or processed, executors commonly:

- **Secure the home.** Locks, keys, insurance, mail and heating.
- **Secure valuables.** Jewelry, cash, important documents and firearms are protected and recorded.
- **Find papers.** Bank, investment, insurance and tax records that the lawyer needs.
- **Build an inventory.** A room-by-room record of the contents, with photographs of notable items.
- **Photograph keepsakes.** So beneficiaries can review them from anywhere.
- **Identify value.** Auction candidates are noted, but not sold.

## What to Ask Your Lawyer Before Dispersing

- Do I have authority to sell or give away items now?
- Should beneficiaries be notified before anything is dispersed?
- Are there specific bequests in the will that must be honoured first?
- Is a formal valuation needed for any items before they are sold?
- How should I record what leaves the home?

Once your lawyer is comfortable, we schedule the dispersal phases: deliveries to beneficiaries, auction waves, donations and disposal, followed by the broom-clean handoff.

> **Document everything**
>
> Whatever you do before probate, write it down. What was secured, where it went, who has the keys. Our inventory and documentation package are designed to make that record complete.

## When Waiting Is Hard

Sometimes waiting is costly: a condo with monthly fees, a rental with a lease end, a vacant house with insurance limits, or a sale that needs vacant possession by a fixed date. Those are exactly the cases to

raise with your lawyer

early, because they can affect timing. Our guide to the

probate timeline

shows where these pressures usually appear.

## Common Scenarios

| Scenario | What usually happens early | What usually waits |
| --- | --- | --- |
| House will be sold | Secure, inventory, keepsake review | Dispersal and listing until authority confirmed |
| Condo with monthly fees | Secure, inventory, plan with building | Dispersal per lawyer's advice |
| Rental with lease ending | Discuss timing with lawyer urgently | Depends on lawyer's advice and lease terms |
| Family disagreement | Secure and document everything | Any dispersal until resolved |
| Small estate | Ask lawyer whether probate is needed | Depends on lawyer's advice |

## Questions We Ask at the Consultation

To plan around probate, we ask where the estate is in the process, whether a lawyer is involved, whether there is a will with specific bequests, whether any items have already left the home, and whether any dates are fixed. Your answers let us plan a first visit that secures and documents the home without getting ahead of your lawyer's advice.

## How We Help in the Early Weeks

An early visit can do a great deal without dispersing anything. Our crew secures and logs valuables, finds and sorts papers, builds the inventory, photographs keepsakes for beneficiaries, and identifies auction candidates. When your lawyer gives the go-ahead, the plan is ready and the clearing can move quickly to the agreed date.

Clearing a house before probate is less about whether and more about what. Secure and document early, disperse when your lawyer says so, and you protect both the estate and your role as executor.

Questions

## Questions Families Ask

### Can we secure valuables before probate?

Securing valuables and building an inventory usually start early, because protecting estate assets is part of the executor's job. Confirm the details with your estate lawyer.

### Can we sell items before probate is granted?

Ask your estate lawyer first. Selling, giving away or donating estate property before your authority is confirmed can create problems, and the answer depends on your estate.

### Is this guide legal advice?

No. It describes common practice. Your estate lawyer is the right person to advise on your specific situation.
